Notice of Public Hearing to Adopt Rules
A public hearing will be held in Legislative Conference Room (LCR) 1 and 2, 3 rd floor, State Capital at 500 E. Capitol, Pierre, SD 57501, on July 12, 2005 at 1:00 p.m. to consider the adoption and amendment of proposed rules numbered
12:79: 01:01 to 12:79: 09:01, inclusive
The effect of the rules will be to establish the South Dakota Certified Beef Program.
The reason for adopting the proposed rules is to set forth:
(1) Qualifications or conditions for using any intellectual property right, mark, or label of the South Dakota Certified beef program;
(2) License application procedures, the terms and conditions of any license, and any official form the secretary deems necessary and appropriate;
(3) Methods and means of conducting inspections, keeping records, and otherwise insuring program compliance by participants in the program; and
(4) Provisions to maintain the confidentiality of business information provided to the secretary by participants in the program.
Persons interested in presenting data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing or by sending them to the South Dakota Department of Agriculture, 523 E. Capitol Ave., Pierre, South Dakota 57501-5254. Material sent by mail must reach the Department of Agriculture by July 22, 2005, to be considered.
After the hearing, the Secretary of Agriculture will consider all written and oral comments it receives on the proposed rules. The Secretary may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
